The mandate in Massachusetts


Andy Barr flags a report in the Boston Globe that offers a glimpse of how the mandate is working, and of its limits, in Massachusetts: 



Massachusetts regulators granted more exemptions last year to residents who said they could not afford the health insurance required by the state, waiving the tax penalty for more than half of those who appealed, according to state data.


Of the 2,637 people who applied, 63 percent received an exemption with 107 cases pending, up from 44 percent the previous year.


State officials said they excused the majority of waiver applicants in large part because of the protracted sour economy, which made insurance unaffordable for more people. Under the 2006 state law that requires most residents to have coverage, regulators have significant latitude to authorize waivers by taking into account factors such as a home foreclosure.





How about this:


Milan (AsiaNews) – Italy’s financial police (Guardia italiana di Finanza) has seized US bonds worth US 134.5 billion from two Japanese nationals at Chiasso (40 km from Milan) on the border between Italy and Switzerland. They include 249 US Federal Reserve bonds worth US$ 500 million each, plus ten Kennedy bonds and other US government securities worth a billion dollar each. Italian authorities have not yet determined whether they are real or fake, but if they are real the attempt to take them into Switzerland would be the largest financial smuggling operation in history; if they are fake, the matter would be even more mind-boggling because the quality of the counterfeit work is such that the fake bonds are undistinguishable from the real ones.

What caught the policemen’s attention were the billion dollar securities. Such a large denomination is not available in regular financial and banking markets. Only states handle such amounts of money.

The question now is who could or would counterfeit or smuggle these non-negotiable bonds.

In order to stop money laundering Italian law sets a ceiling of 10,000 euros per person for importing or exporting money without declaring it. The penalty for violating the law is 40 per cent of the money seized.

If the certificates were real, for Italy it would be like hitting the jackpot. The fine alone would amount to US$ 38 billion, five times the estimated cost of rebuilding quake-devastated Abruzzi region. It would help Italy’s eliminate its public deficit.

If the certificates are fakes the two Japanese nationals could get a very lengthy jail sentence for fraud.

As soon as the seizure was made the US Embassy in Rome was informed. Italian and US secret services were called in to assist the Italian financial police.

Some important international financial newspapers had already reported on the existence of “funny money” circulating on parallel, i.e. unofficial, financial markets.

For AsiaNews a few points need considering:

1. When it comes to Italy the world press has tended to focus on Italian Prime Minister Berlusconi’s personal problems rather than on stories like the bonds smuggling affair which has been front page on Italian newspapers.

2. The fear of counterfeit bonds and securities has spread across Asia with the result that real securities are also considered with suspicion.

3. During the Second World War several countries at war printed and put in circulation perfectly counterfeit enemy money. It is also historically established that some central banks, like the Bank of Italy 65 years ago, issued the same securities twice (identical registered number and code). This way they could print more money with legal tender than they officially declared. The main difference though is that 65 years ago the world was involved in a bloody war, which is not the case today.

On December 14, 2007, Maria Lauterbach disappeared in Jacksonville, NC. On January 10th of this year, local police investigators found her body and that of her unborn child buried under a fire pit in the back yard of 103 Meadow Trail in the Half Moon community, just outside the Jacksonville city limits. This week it was announced that the home, owned by Cesar Laurean and his wife, would be sold "As is, where is" at a foreclosure auction on January 5, 2009. The sale is being handled by the firm of Brock and Scott, PLLC, of nearby Wilmington, NC. A foreclosure notice set to display later in the month in the Jacksonville Daily News will detail the specifics of the house and property. From outward appearances it is a ranch style house of red brick and white siding with an attached garage.

This is just the latest twist in a case that still has far more questions than answers. Maria Lauterbach was a Lance Corporal in the Marine Corps., stationed at Camp Lejeune, NC. Maria Lauterbach began to date Cesar :Laurean in the Spring of 2007. By May, she learned that he was married to Lance Cpl. Christina Laurean, also stationed at Camp Lejeune. The Laureans have a young child together. On May 11, 2007, Maria reported to her command "two incidents of a sexual nature", and she filed a complaint with the NCIS. She was given a pregnancy test at that time and it was negative. After NCIS opened a rape investigation, Maria was reassigned to a different office and Laurean was ordered to maintain a distance from her of 1000 feet. On May 18, Laurean was interviewed by NCIS agents and denied that he had any sexual contact with her. She fell ill on June 27, and was given another pregnancy test. Her date of conception was estimated to be May 14, which was after she made the original allegations of rape, which had allegedly occurred in April. Over the summer, Maria was apparently harrassed at work by people other than Laurean. Someone keyed her car and she was slapped at one point by another Marine, according to the press conference held by Camp Lejeune officials in January of this year. The NCIS decided in October to wait until the baby was born and do a DNA test to determine if Laurean was the father before proceeding with the case. In November, Sgt. Daniel Durham let Maria Lauterbach move into his home in Midway Park because of her situation. On the day that she disappeared, there were no formal charges against Cesar Laurean at the time and he was not considered a flight risk or a danger to Maria.

Ms. Lauterbach left a note for her roommate saying that she was leaving, and disappeared December 14 from the Midway Park area, several miles from Half Moon where Laurean lived. Her car was eventually located at the bus station, where it had apparently been for several days. Questions abound about how she got from Midway Park to Laurean's home in Half Moon, and exactly how the car got back to the bus station. Did she go to his house of her own free will? To tell him that she was going UA and that the case against him would be over? It wouldn't be, of course. Once she made the allegations, his military career was over, whether he was ever convicted of any of the charges against him or not. Did they fight over that and he murdered her? And what about his wife? The District Attorney's office has repeatedly declined to charge his wife with anything. His wife presented the authorities with a note saying she was buried in the back yard and they recovered the body on January 10th. Laurean had supposedly left the note and left town the day before. The neighbors were very forthcoming with stories of how his wife came over and borrowed a shovel in the later part of December, and about the fire and how terrible it smelled and of the crowd of Marines that were present that day, also near the end of December. They also told news media of how Laurean's wife complained about having to repaint rooms of the house. To cover up the blood? After he left and before his capture, his wife was in contact with him by phone, but this is also supposedly something that is not a criminal act.

Laurean's wife is still stationed here in the Marine Corps at Camp Lejeune. She was recently granted leave by the Marine Corps. to travel to Mexico and visit her husband. The District Attorney's office in Onslow County agreed to not seek the death penalty and it was assumed that he would be returned here for trial shortly. However, he has appealed again on the basis of the fact that his only other sentencing option should he be found guilty is life without parole. He is petitioning the Mexican Government for assistance on the basis that this is cruel and unusual puinishment as well. He has allegedly killed a twenty year old woman and her unborn child. While NC law does not provide for a separate charge of murder for the death of an unborn baby, you really have to wonder what this guy's thought process is. He is charged with being responsible for the deaths of two people. What does HE think is appropriate punishment? Whether the first contact between them was rape or consensual, he was a married man pursuing a younger woman under his command. For those of you not familiar with military law, he was in violation of it on several fronts, besides the fact that he was apparently giving no consideration to the effect of his actions on his wife and child. This entire situation came from actions initiated by him.

So, on January 5, 2009, the scene of the crime will be sold to the highest bidder. The housing market here in Jacksonville is not in the dismal shape that it is in the rest of the country. This area is expecting an influx of at least eleven thousand permanent active duty Marines and their families in the next couple of years. New homes are going up on every empty patch of land and there is little problem selling existing ones. If a real estate company buys it with an eye to reselling it, they will have to inform any prosepective buyers of the house's history.

The crowds of sightseers and the hoards of national media reporters are long gone. The yard is overgrown with weeds that have turned brown with the recent frosts. Very little is reported on the case these days. We were reminded of it briefly a couple of times this year when other military women in the area, one of whom was also pregnant, were murdered. When asked about the case recently, DA Dewey Hudson replied that he is very busy these days preparing for fifty four other homicide cases that his office is prosecuting. coalition of seven major public pension systems, led by New York City
Comptroller John Liu, has asked the boards of four of the largest U.S.
banks to examine their mortgage and foreclosure practices.

 

In
a letter dated January 6, the pension fund coalition urged the Audit
Committees of Bank of America Corp, Citigroup Inc, JPMorgan Chase &
Co, and Wells Fargo L& Co to launch independent examinations of their loan modification, foreclosure, and securitization policies and procedures.

 

"This
will help to prevent future compliance failures and restore the
confidence of shareholders, regulators, legislators and mortgage
markets participants," the coalition said in the letter.

 

Bank representatives could not be reached for immediate comment on Sunday.

On
January 7, in a decision that could slow foreclosures nationwide,
Massachusetts' highest court voided the seizure of two homes by Wells
Fargo & Co and US Bancorp after the banks failed to show they held
the mortgages at the time they foreclosed.

 

That
sent fears through the market as investors worried that decision could
threaten lenders' ability to work through hundreds of thousands of
pending foreclosures.

 

The
Supreme Judicial Court of Massachusetts' unanimous decision upheld a
lower court ruling and was among the earliest cases to address the
validity of foreclosures done without proper documentation.

 

That
issue, including the use of "robo-signers" who approved foreclosure
documents without reviewing them, last year prompted an uproar that led
lenders such as Bank of America, JPMorgan Chase and Ally Financial Inc
to temporarily stop seizing homes.

 

Courts
in other U.S. states are considering similar cases, and all 50 state
attorneys general are examining whether lenders are forcing people out
of their homes improperly.

 

The
pension fund coalition represents more than $430 billion in pension
fund investments, including $5.7 billion invested in the four banks.

 

Liu
represents the five NYC pension funds. The coalition also includes the
Connecticut Retirement Plans and Trust Funds, the Illinois State Board
of Investment, the Illinois State Universities Retirement System, the
New York State Common Retirement Fund, the North Carolina Retirement
Systems, and the Oregon Public Employees Retirement Fund.

 

The
coalition called for the banks to report the findings of their
independent examinations in their 2011 proxy statements this spring.

 

At
the end of the last year, the coalition's combined holdings in each
bank included: 97.1 million Bank of America shares valued at $1.3
billion; 226.6 million Citigroup shares valued at $1.1 billion; 40.7
million JPMorgan Chase shares valued at $1.7 billion, and 50.6 million
Wells Fargo shares at $1.6 billion.

It's about
time public pension funds get involved and use their clout to pressure
banks to examine their loan modification, foreclosure, and
securitization policies and procedures. I'm not sure anything will come
out of this but the foreclosure crisis has sounded the alarm bell and
banks need to respond to make sure that measures are in place to prevent
this type of abuse from ever happening again.

A small number of states continue to be the hardest hit. California, Florida, Arizona, Illinois and Michigan account for half of the nation's total filings.

Many analysts believe that housing cannot recover in markets where unemployment is above 10%. Low interest rates on mortgages have not aided home sales, at least not in a measurable way. Government's attempt to rectify the situations have had mixed success. Tax credits, offered early in the year, boosted buying activity, but those benefits expired in April. The Home Affordable Modification Program (HAMP), meant to refinance mortgages to keep people in their homes, was simply a failure.

Another problem that faces the housing recovery is that many potential home buyers believe that prices could go even lower. S&P forecast that home prices could drop another 7% to 10% this year.

James J. Saccacio, chief executive officer of RealtyTrac, offered little hope for the beginning of 2011. He said "many of the foreclosure proceedings that were stopped in late 2010 -- which we estimate may be as high as a quarter million -- will likely be re-started and add to the numbers in early 2011."

Home foreclosure has skyrocketed in the last year, thanks to Adjustable Rate Mortgages (ARMs) increasing sharply and the current economic crisis that the country is in. Most foreclosures are affecting those in the lower-income or lower-credit rating area, commonly known as the 'sub-prime' sector. Nonetheless, homes are being repossessed from middle-class, average American families, as well as those financially located below the middle-class at an unprecedented rate. There are ways to avoid this terrible situation and understanding the rules of credit is a key component. With holiday spending and debts looming, now is the time to make sure you know exactly how to avoid losing your home.

First of all, make sure you understand what foreclosure is and when it can happen. Foreclosure is what occurs when a borrower falls behind on their mortgage payments. Because technically, the bank from whom you received a home loan owns your home, they can take possession of it at any time should you fail to pay your monthly mortgage. While different lending institutions vary, simply making a late payment one month will put a permanent red mark on your credit history and missing one payment can set the foreclosure wheel in motion. More than any other bill you could possibly have, always pay your mortgage. Put this in front of credit cards, student loans, utilities, or anything else you might have to pay. Remember that your credit rating is taken into consideration for new mortgages, personal, auto, and education loans as well as for credit card applications. Some employers also run credit checks on employment candidates. A black mark on your mortgage could keep you from owning another home and even from getting a job. Sorting out and addressing your mortgage can make your life much easier, just make sure that your home is your number one priority.

Look to see what sort of mortgage you have. Right now, a 30-year fixed rate is the most desirable mortgage for anyone who can't make huge monthly payments. An ARM mortgage can change after the introductory rate period expires. For example, a 5-year ARM means that for the first five years, the rate will stay fixed at the original interest rate. Usually this rate is around 6%. However, after the 5 year introductory period, this percentage can jump at a rate of 5% per year. This means that three years after your introductory rate ends, your interest could be closer to 20% than 6%. This phenomenon is a major cause of the current foreclosure nightmare that's being seen across the country. As interest rates leap upward, individuals are found to be paying unimaginable amounts of money each month. If your monthly payment is around $800 for the first five years, it may rise sharply after that introductory period. The worst part of this is that the incredibly high payments you could suddenly be facing will not cause your total balance to decrease any faster. This is simply money that your lender is making off of your mortgage.

In recent months the Federal Reserve or "the FED" has cut the interest rate on loans across the board. The current interest rate on home loans is much lower than it was even a year ago and if the trend continues, will continue to decrease through the beginning of 2008. If you have an adjustable rate mortgage, now is the perfect time to look at refinancing into a fixed-rate mortgage. Before your interest shoots upward you should seriously consider locking in a fixed-rate plan. At the moment, the housing market in the United States is looking bleak and many homeowners who planned on turning a profit in a few years off the sale of their homes are now looking to stay in their homes longer than they may have originally planned. Instead of trying to sell a home quickly to avoid that interest jump, look into refinancing as a more viable option. This is also advisable if your current mortgage is a fixed rate but has a much higher interest rate than those presently available. The one thing to remember with refinancing is that you will have to pay closing costs a second time. Usually these can be rolled into the amount of the loan and the cost of the refinancing is, in the long term, far less than the cost of unruly interest.

The federal government has also recently begun discussion on a 'freeze' for adjustable-rate mortgages to slow the foreclosure trend and to secure money for the lending institutions. Those who are eligible for this freeze are those borrowers who took out their loans from the start of 2005 through July 30th of this year with loan rates that are scheduled to rise anytime from January 1, 2008 to July 31, 2010. Although this hasn't been confirmed yet on a federal level, many lenders are agreeing to this procedure on a state-to-state level and beginning the process for qualified borrowers. If your loan qualifies based on the time period, contact your lender immediately and see if a freeze is possible on your mortgage. The freeze isn't permanent and refinancing is still the best solution, but this will buy you some time. This will allow many homeowners enough time to find a long-term solution. Directly contacting your lender is the best way to find out if you qualify for a temporary freeze.

Refinancing can take some time, so make sure that you start the process earlier rather than later. Waiting until your introductory rate is nearly expired is only going to end up costing you more money. If you're in a desperate situation in regards to your mortgage, contact your lending bank right away. Often they may be able to help you avoid foreclosure and are usually willing to work with a borrower as long as you contact them before your first late payment. This is especially crucial if you're experiencing any sort of major life adjustment, such as losing a job.

Although it may seem impossible, there are ways to make extra money, or at the very least, save enough money to cover a few difficult months until your refinancing or home sale can take place. Be aware of where you spend the most money. Try taking the bus to work to save on gas. Don't eat out for meals until your financial situation is settled comfortably. Make a grocery list of the necessities and buy things that can make several meals, such as boxes of pasta and rice. As unappealing as eating spaghetti for a month may seem, it's far more appealing than losing your home and also, your credit rating. When bills show up, make sure that you pay them in order of importance. The first, of course, being your mortgage. Once this is taken care of, pay any bills that charge a high interest rate. Credit cards and loans will usually report unpaid balances to the credit bureaus within a few months. Don't let these go past 90 days or you may see a large dip in your credit score which can also affect your ability to refinance or eventually, purchase a new home. Car payments are also vital if you rely on your vehicle for transportation, otherwise you may want to sell your car and opt for public transit. This money can be used to pay your mortgage and it's a very good option if you can rely on public transport in your area. Other bills like utilities are important, but often service won't be stopped until after several months of non-payment. If you absolutely can not pay all of your bills, these are the best to hold off on. Things like cable television, satellite radio, newspaper subscriptions, or anything else that provides entertainment should be stopped as well as anything else that is not a vital necessity. These are bills that may seem like small amounts, but they can add up quickly. Cancel these immediately and save the money usually spent on them to pay your mortgage for as long as possible. The fewer bills you have, the easier it will be to apply your income to your home loan.

If you fear that foreclosure may be in your future, make sure you check every available option. Even if the situation seems hopeless, there may be a solution available. Many city and local governments have set up offices designed specifically to assist homeowners. Check your city's website to see what sort of assistance they offer. A wealth of resources are also available on line, offering everything from a basic understanding of interest rates to tips on how to raise your credit score. Sometimes avoiding foreclosure is as simple as refinancing or taking a part-time job to make your payments on time. Sometimes, it's far more complicated. No matter what your situation, make sure you talk to your lending bank as soon as you think problems may arise. Then check with your city and surrounding area to see what sort of free aid is available. The efforts to stop foreclosure are nation-wide and with good reason, the current housing market is in dire need of a boost. You may find many available forms of assistance to help you keep your home and your life together.

personal finance blog




Admission to my own personal guilt in not sharing this business with internet folk earlier, I decided to bring to you a bit of 'eye candy', with a huge side order of 'red flag' to boot. Today, I will show you Paybox.me, a mysterious company making search engine progress, using folks for their marketing efforts, and why you shouldn't deal with them.


This company, a payment processing venture that aims to be the 'biggest processing company on the internet', remains in total secrecy from all of its 270,000 users. Searching Whois yields a Webguard, which blocks all of their user information from being visible. If I was anything of an aspiring future company, I would not want to hide myself from potential investors, buyers, or agencies that may help me grow.


Moreover, this company cannot be reached via email.  We know of only 2 known emails that work (we tried all @paybox.me possibilities) - admin@ and news@.  Of course, you will not get replies from them.  And, they block commentary on their website blog posts.  No customer service.  Yet somehow, they can afford to place $20 a day in the accounts of 270,000 active users.  Since their website doesn't say a thing about 'Paybox Currency' or 'Paybox Bucks', this company is claiming a world known currency by giving out Dollars.  Wish I had money like that to share so flagrantly.


They plan to soon 'Open The Box' by offering digital products from merchants that - you guessed it - are invisible.  Website currently has a voting mechanism where you can vote where to spend this Paybox balance you have, with some of their top vote draws being eBay, Amazon, Walmart and Tiger Direct.  Not sure about you, but I will not accept the business from a company that cannot be identified, in a currency that they claim to be 'autonomous'.

Last we heard in October, the Department of Justice had prepared a flurry of subpoenas to delve into the handling of campaign finances in John Edwards’ presidential run, with a specific eye towards the use of some funds to keep the Rielle Hunter scandal under wraps.  Today, the Associated Press reports that the grand jury has targeted Edwards in its probe, and not just Edwards.  Subpoenas have been issued for Alliance For a New America (AFNA) and linked organizations, where millions of dollars got spent with no public accounting:



A federal criminal investigation targeting John Edwards is examining how much the two-time presidential candidate knew about money used to cover up his extramarital affair and out-of-wedlock child and whether he had other practices that pushed the bounds of campaign finance laws, people involved in the case have told The Associated Press.


A federal grand jury meeting in Raleigh, N.C., is combing through records and testimony involving several political organizations and individuals connected to Edwards and trying to determine if the former North Carolina senator and 2004 vice presidential nominee broke any laws. A recently issued subpoena focuses on a web of these political groups allied with Edwards, according to subpoena details provided to AP that offer a glimpse into the investigation being conducted behind closed doors.



The situation gets murky indeed when looking at AFNA:



Atop the subpoena list, read to the AP by someone with access to a subpoena, is the Alliance for a New America, which is what is known as a political 527 group, named for the tax code section that governs it. Also on the list is a like-named private entity called Alliance for a New America LLC, or AFNA LLC, and Edwards’ former campaign manager Nick Baldick, who ran the political 527 group in support of Edwards’ bid for the 2008 Democratic presidential nomination. (IRS records for the same groups refer to the groups as Alliance for New America, without an “a.”)


Baldick and his attorney Jim Lamb would not comment on the federal investigation, but Lamb said Baldick has been told he is not a target of it.


Federal records show that about $3.3 million of the $4.8 million raised by the 527 was distributed to AFNA LLC for unspecified “consulting services.” The 527 and the LLC shared not only their name, but the same Alexandria, Va., post office box and the same contact, a Baldick associate named Katherine Buchanan. A crucial difference between the two Alliance entities was that the LLC was a limited liability company that did not have to publicly disclose how its money was spent.



The question will be whether that distinction was legal on its face, or whether it was used as a dodge to funnel money illegally to Edwards for his own personal use.  If the grand jury can connect the expenditures on “consultants” to those who tried keeping the lid on Edwards’ relationship with Hunter, the legality of the edifice may be a moot point anyway.  Presumably, the grand jury and the investigators are looking for someone on the inside to testify to how the money got spent. If they do and the money got directed to hide Hunter and keep her quiet, then everyone involved may face conspiracy charges.


AFNA isn’t the only entity under scrutiny, either.  The One American Committee paid Hunter over $100,000 for campaign Internet videos that never got published.  They also want to see how massive contributions from Fred Baron and Bunny Mellon were distributed, the latter of which got hidden in boxes of chocolates according to former aide Andrew Young’s book with the express purpose of keeping Hunter quiet.  Baron claimed to have supported Hunter financially without Edwards’ knowledge, but Young’s book says that Edwards agreed to hit up Mellon for hush money, which the grand jury seems to think may be an interesting avenue of inquiry.


None of this means anything until the grand jury produces indictments, of course — but becoming a target of a grand jury is the one way that happens.

None of us will ever wholly agree on money. Some people hate debt, others believe that it is a much needed financial tool. Some abscond whole-life insurance, others swear by it. Some argue gold is a solid investment, others promote by mutual funds. In order to define your own viewpoint on money, you really have to absorb and filter. You should not just listen to one person's advice about money, rather you should listen to several and make your own decisions based on what you learn. For this to happen, we need good sources of financial information. Here are four great personal finance blogs that you need to read.

The Simple Dollar - The author of this blog really knows his stuff, and has a lot of time to put into his blog. It's very common to see four or five articles a day from him, and his advice is always logical and well researched. He offers unique insights on ways to save money, recently he wrote an article about how one could live on $10 a month for food, and it became so popular that the traffic brought his websites to its knees. The Simple Dollar is backup and in action, and Trent is giving his well-researched tips and tricks on becoming financially independent once again.

Stop Buying Crap - The person who writes this blog only goes by the name of "Cap", short for "Captain Crunch." The focus of this blog is to get readers to stop spending so much on things which do not make us happy or are just outright waste. Cap's humorous writing style and great Photoshop abilities make for very enjoyable and educational reading.

Crazy Money - This blogger doesn't post too often, but when he does, it's usually good stuff. The author, Matt, focuses on some of the more technical aspects of finance. He often shows spreadsheets that he uses in his own financial life that most of us would be very wise to make use of. It might not always be the most exciting information, but it's definitely worth reading.

No Credit Needed - America has a culture of borrowing money for seemingly everything. No Credit Needed offers a unique and contrarian viewpoint when it comes to borrowing money. Some personal finance are bragging about the money they make from credit card arbitrage, but No Credit Needed stays miles away from that game. If you want to borrow money, that's fine and dandy, but it's still nice to hear someone with a differing view point every now and then.

These are four very good websites which all offer their own unique paradigms on money. Each of which will offer you the very best they have to offer. Of course you should not limit your reading to just a few web logs, but rather be read as a part of a larger amount of financial literature that you take in. Even if you do not enjoy reading, or reading about money, you still need to do it. It might not be fun, but it's you're money, and you don't want to mess it up.
